Possible Jail Time For Refusing A Breathalyzer Test

Cops are cracking down! If you thought you could get away with driving buzzed or drunk by refusing to take a breathalyzer test, think again! In Allen County if you refuse to take a breathalyzer test, they'll get a search warrant and draw blood from you instead - from the county jail. Judges and lawyers equipped with fax machines can now get a warrant for a blood test within twenty minutes.  

“There were two people who would have refused over the weekend who then went ahead and agreed to the Breathalyzer after hearing they would have to have a blood draw,” said Deputy Prosecutor Michael McAlexander.

For those who plan on refusing the search warrant and not getting blood drawn, they have two options: They'll be charged with resisting law enforcement -or- they'll be taken in front of a judge for a contempt of court hearing (which, if cited, can lead to 180 days in jail).


Hopefully these harsher consequences will keep drunk drivers off the road.. and maybe someday these will be standard practices in every state!
