There will soon be a no refusal
policy when it comes to DWI’s in Missouri. Green Courte deputies will now be
able to seek search warrants for blood samples if they believe drivers are
drunk or under the influence at checkpoints.
Major Kevin Spaulding had this to
say, “If you refuse a Breathalyzer, we’re going to apply for a search warrant
for your blood.”
DWI checkpoints are funded in
Greene County through a $65,000 grant, which reimburses law enforcement for
overtime to man the patrols. This grant would also pay for the medical
personnel drawing blood.
Tyson Martin, a Springfield
criminal defense attorney, said the no-refusal DWI checkpoints would be an
expansion of the current practice of drawing blood from drivers when there’s a
death.
